Welcome to MyConcierge provided by Provis – Sole Proprietorship LLC (“Provis“, “We”, “Us”, “Our”). These terms and conditions (“Terms“) are a legal agreement between Provis and the user (“You”), of the MyConcierge services (“Services“). By accessing or using the Services, You acknowledge that You have read, understood, and agree to be bound by these Terms. If You do not agree with these Terms in their entirety, You are not authorized to use the Services in any manner or form.
Scope of Services: Provis offers the MyConcierge platform, which serves as a facilitator for a variety of services provided by third-parties(“Service Providers“). These Services include, but are not limited to, chauffeur and transport services, home beauty treatments, event management, pet care, and more as detailed on our promotional materials. The exact scope of services may evolve or be modified over time.
Eligibility and Registration: To use the Services, You must be at least 21 years old and capable of entering into legally binding contracts. You may be required to register an account and provide accurate, complete, and updated information as requested. You must also be a resident of one of our managed communities within Aldar managed properties.
Role of Provis: Provis’s role is limited to facilitating the availability of the Services and acting as an intermediary for bookings and communications between You and the Service Providers. Provis does not provide, own, or control any of the services offered by Service Providers and is not responsible for the accuracy of the bookings or discrepancies in the availability timings of either You or the Service Provider
Contractual Relationship: Any service You book through MyConcierge constitutes a binding legal agreement directly between You and the Service Provider. Provis is not a party to this agreement. You acknowledge that Service Providers are independent contractors and not employees, partners, or agents of Provis.
Payment and Billing: All payment are directly made to the Service Providers, Provis does not receive any financial income from the promotion or the facilitation of these services. All payments are subject to these Terms and any additional terms provided at the time of booking. Prices for services are determined by the Service Providers and may be subject to change. Any refunds should be claimed by You and processed from the Service Provider only and directly.
Any disputes related to payments, refunds, or billing issues must be addressed directly with the service provider. Provis may provide contact information for the service provider upon request.
User Conduct: You agree to abide by all applicable laws and regulations when using the Services and to be responsible for all activities conducted through your account. You shall not misuse the Services for illicit or prohibited activities.
Liability and Disclaimers: Provis and any of its affiliates or subsidiaries and its respective employees, directors or subcontractors shall not be held liable for the actions, errors, or omissions of Service Providers. We do not guarantee the quality, safety, or legality of the services provided. Our liability to You in connection with the Services shall be limited to the extent permitted by law, and in no event shall We be liable for indirect, incidental, special, consequential or punitive damages caused by You or the Service Provider
Complaints and Disputes: Should You have any complaints about the Services, we operate a complaints handling procedure which we will under no guarantee use to try to resolve disputes when they first arise, please let us know if You have any complaints or comments. Please see our Contact Us page for details of how to get in touch with us. Provis may offer customer support and attempt to assist in resolving disputes but does not guarantee any outcomes
Indemnification: You agree to indemnify and hold Provis and any of its affiliates or subsidiaries harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against us by any third party due to or arising out of or in connection with your use of the Services.
Amendments: Provis reserves the right to amend these Terms at any time. All amendments will be posted online and effective immediately upon posting. By continuing to use the Services after amendments are made, You agree to be bound by the Terms as amended.
Contact and Notices: All notices to Provis should be sent via the contact information provided on the MyConcierge communication. We will send notices to You via the contact information You provide during registration or as updated by You.
Termination: Provis may terminate your access to the Services without prior notice and liability for any reason..
Entire Agreement: These Terms constitute the entire agreement between You and Provis regarding the use of the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.
Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permissible, and the other provisions of these Terms will remain in full force and effect.
No Waiver: Provis’s failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Data Protection and Privacy: Provis is committed to protecting the privacy and security of your personal data. We will collect, use, and disclose personal information in accordance with applicable data protection laws.
Service Level Agreements : Whilst Provis facilitates the connection between You and third-party service providers, we strive to provide the highest level of service quality and responsiveness. However, we do not guarantee the performance or quality of services provided by third parties. Any specific service-level expectations will be communicated to you at the time of booking.
Links to Third Party Sites: The MyConcierge platform may contain links to third-party websites or services that are not owned or controlled by Provis. Provis assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Provis shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such websites or services.
Intellectual Property Rights: The MyConcierge service/platforms, including its text, graphics, logos, icons, images, and software, is the property of Provis and is protected under intellectual property laws. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without express written permission by us.
Force Majeure: Provis shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Provis’s reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation (including “line-noise” interference).
Governing Law and Jurisdiction: These Terms shall be governed and construed in accordance with the laws of the United Arab Emirates and subject to Abu Dhabi courts jurisdiction
By using MyConcierge, You acknowledge that You have read these Terms, understand them, and agree to be bound by its terms.
